§ 1. DEFINITIONS
Order Processing Time - the time at which the order is produced, completed and then issued to the carrier in order to deliver the Goods to the address indicated by the Customer; The Order Processing Time does not include delivery time (the time between the release of the Goods by the Seller to the carrier and its delivery to the Customer);
Please understand that due to the large number of orders we need from 7 to 14 days to prepare a product for you.
Of course, we always do everything in our power to send you your order as soon as possible.
Business days - means days of the week from Monday to Friday (excluding public holidays);
Client - an entity with full legal capacity which, under the conditions specified in the Regulations, orders in an online store and for the benefit of which services are provided electronically;
Cart - an integral part of the online store and the purchasing system in which the Customer approves the terms of the Order, i.e. type and quantity of Goods, data for delivery or invoice, payment method;
Regulations - these regulations of the Online Store;
Online Store (Store) - an internet service available at www.seemsdifferent.pl using which the Customer may, in particular, place an Order for available Goods;
Product - a product shown in the Online Store, which may be the subject of a Sales Agreement; the essential properties of each Commodity are available on the Shop subpage assigned to it; the image of the Goods presented on the Online Store's website is a visualization of its actual appearance and is for information purposes only;
Sales Agreement - a contract for the sale of Goods within the meaning of the Act of March 2, 2000 - Civil Code, concluded in accordance with the provisions of the Regulations between the Seller and the Customer, via the Store's sales system;
Order - Customer's declaration of intent leading directly to the conclusion of the Sales Agreement, with an indication of its essential conditions.
§ 2. GENERAL PROVISIONS
A. These Regulations define the rules of using the Online Store, in particular the conditions for placing the Order and its modification, making payments and other rights and obligations of the Customer and the Seller.
B. The sale takes place via the Internet in the form of a distance contract, between the ordering party, hereinafter referred to as the customer, and the seller, hereinafter referred to as Seems Different.
C. Each person placing an order (hereinafter referred to as the Customer) in the online store is obliged to read the regulations. Ignorance of the Regulations does not absolve the Customer from the principles contained in it.
D. Information about products in the Store, including descriptions and prices of Goods, constitute an invitation to submit an offer to conclude a Sales Agreement within the meaning of art. 71 k.c., in accordance with the conditions of the Regulations.
F. The Customer is prohibited from: providing content prohibited by law, including violating personal rights and other rights of third parties; acting in a way that violates the law or to circumvent the law, and in contradiction with the principles of social coexistence or morality; use the Online Store in a way that disrupts its functioning or is burdensome for the Seller and other Customers.
G. The Seller provides protection of the electronic message and digital content by applying technical and organizational measures to secure them, in particular data before their acquisition by unauthorized persons, including through SSL encryption, access passwords or anti-virus programs and against unwanted software. At the same time, the Seller indicates that the use of the Internet and services provided electronically may be jeopardized by the entry of malicious software into the ICT system and the user's device, as well as unauthorized access to customer data, including personal data, by third parties. In order to minimize these threats, the Customer should use appropriate technical security measures, eg using antivirus programs or protecting user identification in the Internet.
§ 3. ORDER
A. Orders can be placed electronically via the sales system of the Store, 24 hours a day, 7 days a week throughout the year.
B. The buyer can be any natural person, legal person or organizational unit without legal personality, having an e-mail account and having full legal capacity.
C. The Customer prepares the Order by virtually adding Goods to the Basket. Effective addition causes, that in the tab Cart changes the indicator of Goods on the list of Orders, which you can freely modify. After confirming the selection of the Goods, the Customer indicates in the order form his data, address for the shipment, form and price of the shipment and the method of payment for the Order. After completing the Order, the Customer approves it and sends it to the Seller.
D. Each time, before sending the Order to the Seller, the Client is provided with a summary of the Order for confirmation, i.e. the total sum and detailed information of the Order.
E. In the order placement process, until the "Order with payment obligation" button is activated, it is possible to detect and correct errors by the Customer in the Order and its modification, via the Online Shop's sales system.
F. After this, the Customer may change the Order, in particular, correct errors in the entered data, until sending the shipment with the Goods by direct contact with the Seller immediately by e-mail.
G. The information presented in the Online Store is an invitation to submit offers by customers. Placing an Order by the Customer is tantamount to submitting a declaration of will to conclude the Goods Sale Agreement. The conclusion of the Sale Agreement takes place at the moment of sending to the e-mail address given in the Order confirmation of acceptance of the Order for execution by the Seller.
H. The order is effective if the Customer correctly completes the Order form and correctly provides contact details, including the correct address to which the Product is to be sent. The seller will contact the customer when the data is not complete. If it is not possible to contact the Customer at least twice, it is considered that the benefit is impossible and the Seller may cancel the Order or withdraw from the contract.
I. The consolidation, security and access to the order data and the General Terms and Conditions (sales regulations) takes place via electronic mail. You can view earlier orders under your account after logging in. A digital document confirming the conclusion of the Agreement will be sent to the Customer who has placed the Order.
J. The delivery time for the Goods is up to 7 to 14 Business Days.
K. Realization of the Order begins after the payment operator has posted the payment.
After the above Time of Order Execution, The goods are issued to the carrier.
§ 4. PRICES AND LIMITATIONS OF PAYMENTS
A. The prices listed on the Online Shop website are gross prices (including all taxes, including VAT), do not include shipping costs. The total price of the Order is calculated according to the choices made by the Customer in the Order form, according to the rates indicated in the summary of the Order.
B. The binding price is indicated in the summary of the Order at the time of its sending to the Seller.
C. Payment methods are limited to:
- PAYPAL payment;
- PayU payment
D. If the Customer fails to make payment within 3 (three) working days from the date of sending the Order, the Order will be canceled.
E. Seems Different is not a VAT payer and issues invoices at the customer's request. The sales document is a confirmation of the essential elements of the order.
F. Prices given in the Online Store may change (eg as part of a promotional campaign or sale of Goods). The terms of the Order may not be changed in relation to the Customer who submitted the offer in the manner indicated in § 4 of the Regulations, before making the price change.
§ 5. SHIPMENT
A. Shipments are delivered in a manner chosen by the Customer from among the options made available by the Seller. Delivery of the Goods is limited to the forms indicated in the Order form.
B. The cost of shipping the Goods is paid by the Customer. This cost is calculated on the basis of delivery prices indicated in the Order form and it is added to the amount of the Order in the summary, after selecting the delivery option by the Customer.
The condition of sending the Goods is the payment of the value of the Order.
C. The goods are sent to the address indicated in the Order form. The Seller will contact the Customer immediately if the form is incorrectly completed and the Order can not be delivered efficiently.
D. If before shipment it appears that it has suffered a loss or damage, the carrier is required to establish the condition of the shipment and the circumstances of the damage as soon as possible. The carrier should do so also at the request of the customer, if he claims that the shipment is violated. The risk of accidental loss or damage to the Goods passes to the customer upon its release.
E. The cost of courier shipping to Poland is PLN 20.
F. The cost of courier shipping to below countries is PLN 60
UK, Austria, Belgium, Czech Republic, Denmark, France, Spain, Ireland, Luxembourg, Germany, Slovak Republic, Sweden, Hungary, Italy, Switzerland
§ 6. WITHDRAWAL FROM THE AGREEMENT
Below we present the terms of returns:
- We accept returns (note - personalized products can not be returned because they are made on special request)
- shipping costs are covered by the customer
- You can return the goods within 14 days of receiving the order
- the product you return must be in the same condition as you received it.
- products can not be used. All items will be checked individually upon return.
- If the return is recognized, we will refund the price for the purchased product via the original payment method
- items you want to return belong to you until we receive them, so please keep the proof of postage. It is also a good idea to purchase insurance for the value of items sent.
§ 7. COMPLAINT
A. The Seller is obliged to provide the Customer with goods without defects. The Seller is liable to the Consumer, if the Product has a physical or legal defect (warranty). The consumer is entitled to a warranty in the form of removing the defect, replacing the item with something free from defects.
B. Complaints are only for Consumers. The Parties, the Customer who is not a Consumer and the Seller, exclude warranties for defects.
C. Complaints should be submitted to the postal address indicated in the Contact. To improve the complaint procedure, the advertised Goods should be delivered together with proof of purchase and complaint.
D. The Seller will respond to the Consumer's request within 14 (fourteen) days.
§ 8. PERSONALIZED PRODUCTS
Personalized products are made to order, so please bear in mind that they are not refundable
If you find a defect in the personalized product, please do the same as in the case of normal products in our online store
§ 9. MAINTENANCE AND PRODUCT CARE
Please use the following rules to ensure that the bag has retained its appearance for a long, long time:
avoid excessive soaking of wood
do not carry heavy things, try not to overload the handbag so that there are no excessive stresses, and thus that the wood does not break
do not clean chemically
If soiled, gently wipe the wood with a damp cloth
if you notice excessive drying of the wood (this may happen due to weather conditions), we advise you to first clean the wood with a damp cloth and then after drying apply a thin layer of oil dedicated to wood. Such a procedure should be repeated preventively every 3-4 months.

§ 10. FINAL PROVISIONS

B. Customers' personal data provided when placing an order in the Store are processed by the Store solely for the purpose of processing orders.
C. By placing an order, the Customer agrees to use the Store in accordance with the provisions of these Regulations, as of the day of placing the order. Lack of acceptance of the provisions of these Regulations makes it impossible to purchase the Goods offered by the Store.
D. Polish law is applicable to the Agreement for the sale of Goods in the Store.
E. In matters not covered by these Regulations, the provisions of the Civil Code or other acts applicable to the operation and operation of the Store shall apply accordingly.
F. The competent court for resolving disputes is the common court having jurisdiction over applicable law.
G. Sklep reserves the right to amend the Regulations at any time. Amendments to the Regulations are effective from the moment they are published on the Store's website. Amendments to the Regulations may not violate the rights of acquired customers using the Store.
H. Store Administrator takes action to ensure that the Store's website is fully functional, to the extent that results from current technical knowledge and undertakes to immediately remove any irregularities reported by customers. The store is not responsible for disruptions in business caused by the failure of the Internet.
I. All photographs, graphics, logos, publications and texts available in the Store are protected by the Act of February 4, 1994. on copyright and related rights (OJ 1994 No. 24 item 83). Any unlawful copying, reproduction or distribution of any content on the Store's website is prohibited. "
